Terms & Conditions of Service
ULU I TRAVEL BY BOAT provides an online platform that connects boat owners for charter trips that are made available for booking by guests seeking to book such charter, which services are accessible at itravelbyboat.com. The boats listed on itravelbyboat.com are not owned by ULU I TRAVEL BY BOAT. The yacht charter arrangement is made by us, ULU I TRAVEL BY BOAT, acting as an agent on behalf of the charter yacht owners.
In paying your deposit you are deemed to have read and accepted the following terms and conditions, which form the agreement between you and us. The details of your yacht charter will be sent to you and are stated on your confirmation email. If there are any significant changes to the price or any other arrangements you will be told at the time of booking; once you have booked, we will do our best to let you know of any changes before you travel.
When making your booking you guarantee that you have the authority to do so and you accept on behalf of your yacht charter party the terms of these booking conditions. You should check the details of your confirmation, as stated in writing on email, carefully to ensure that it accurately reflects the booking you have requested and immediately inform us of any discrepancies. This agreement is made on the terms of these booking conditions which are governed by Panamanian Law and we both agree to submit to the jurisdiction of the Panamanian Law at all times.
We do not accept responsibility for the acts and or omissions of the crew on the yacht you booked. In all scenarios, I TRAVEL BY BOAT is a sales intermediary and cannot be held responsible for any event occurring on board or outside the vessel and during the transfers to/from the vessel. We do not accept responsibility if the fault is caused by you or any member of your party, a third party or an event which we could not with due care have foreseen or avoided.
If ULU I TRAVEL BY BOAT books a yacht for you with another charter agent the booking is subject to the standard terms of the company with whom we have booked your yacht charter. Below are the conditions under which the charters on the website are offered.
Charter includes:

Rental of the boat with crew as described on the boats profile on itravelbyboat.com.

All meals taken aboard (catch of the day, meat, fresh fruits and vegetables). Some boats may exclude 1 meal when chartering for a longer period (often a week or longer). This meal will be taken on shore on client own expense.

A selection of drinks in reasonable consumption. Not all boats include alcoholic beverages in the charter fee. This will be stated on their profile. If you have any specific wishes for beverages please let us know in advance.

Fuel, gasoline, water tank supply.

Dinghy with its outboard engine.

Twin seats kayak aboard some of the boats (please verify on the boats profile).

Snorkeling gear (always better to bring your own if you have it) and fishing rods.

Spear fishing equipment may be available (please verify on the boats profile).

Sheets and shower towels.

General cleaning of the boat after the charter.

Personal travel insurance and third part liability insurance.

Expenses incurred while not on-board the boat: For example: air and land.

Transportation to the boat, local taxes, local visits, community fees, additional excursions, meals in local restaurants, etc.
Payment policy
Deposit: To confirm your booking a down payment of 20 to 30% is required within 7 days of your reservation.
Final payment: If paying by wire transfer, final payment must be made no later than 14 days prior to charter start date.
Payment Methods
The payment methods we accept are: bank transfer, credit card (via PayPal with a 7% fee) and cash on board.
When you request to pay by bank transfer you will receive account information. These accounts accept USD and Euro money transfers. We do not charge additional fees for this payment method, however, any transaction fees charged by the bank are for the senders account.
When paying by credit card we will add a 7% credit card charge to the total amount. We accept credit card payments via the PayPal platform.
If you are converting from Euros to US dollars, we handle the exchange rate from www.xe.com.
Final payment
Final payment is due no later than 14 days prior to charter commencement. Balance reminders are not issued. If you fail to pay on time, the company reserves the right to cancel your charter, without refund of your deposit. The final payment will be made to the charter supplier.
Rates
Rates detailed are subject to change at any time until full payment has been received. We reserve the right to correct any pricing errors or omissions that may occur. We recommend that you book & pay in full as soon as possible to ensure the availability and pricing of any travel services shown.
Travel Documentation
Passports, Visas and Health: You are responsible for ensuring that you possess all necessary documentation including passports and visas for your holiday. For all destinations, you should consult the appropriate consulate. All travelers must have a valid passport for international travel. Many countries require passports to be valid for 6 months beyond your stay. Visas & entry permits are required for many countries. Passports, visas & re-entry permits are the responsibility and cost of the charterer. For health enquiries call your Travelers Medical / Vaccination Centre or see your Doctor. We recommend that you check travel advisory information on your destinations.
Cancellation or Variation of the yacht charter by the Yacht Charterer
If you, as the yacht charterer, wish to cancel your yacht charter you must notify us immediately in writing. Cancellation will be effective on the date at which I TRAVEL BY BOAT receives the cancellation. If you have notified us by email please follow up to check that we have received it. This agreement will govern the law and cancellation process.
Cancellation/Amendment Fees: In the case that a charter is cancelled, we as the agency reserved the right to retain any commissions owing on the charter. If the reasons for your cancellation are covered under the terms of your insurance policy, you may be able to reclaim these charges. If you wish to make changes to the booking after confirmation, we will do all we can to make the necessary arrangements, but as an agent we may have to make additional charges.
Cancellation and Refund Policy
If you cancel the charter or part of the charter the following refunds will apply:

Between 90 to 60 days before first day of charter 25%
Between 59 to 30 days before first day of charter 5%
Less than 29 days before first day of charter 0%
Cancellation or Variation of the yacht charter by ULU I TRAVEL BY BOAT
We will do our best to provide the contracted facilities but occasionally we may have to make a significant change to your charter yacht arrangements. The arrangements are made many months in advance and it is sometimes inevitable that changes may become necessary. We reserve the right to, might this become necessary, change the chartered yacht to another type of a similar or higher standard. We will advise you or your travel agent of this at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. We will contact you to discuss alternative arrangements. If we are unable to provide an acceptable alternative, or if circumstances arise beyond our control, we may find it necessary to cancel your holiday before departure. In this case we will return in full all monies paid by you.
Force Majeure: This means that we will not pay you compensation if we have to cancel or change your yacht charter or travel arrangements in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire adverse weather conditions or other unforeseen circumstances that may amount to force majeure.
We do not accept responsibility if the fault is caused by you or any member of your party, an unconnected third party or an event which we or our supplier could not with due care have foreseen or avoided. We do not take responsibility for services provided by other land, air or sea carriers you will be using on your holiday. Our liability is limited in line with the appropriate international convention.
We reserve the right in our absolute discretion to terminate without further notice the yacht charter vacation arrangements of any client who refuses to comply with the instructions or orders of the company staff, agent or other responsible person whose behavior in their opinions is likely to cause distress, damage, danger or annoyance to other customers, staff, any third party or to property. Upon such termination our responsibility for your yacht charter ceases and we shall not be liable for any extra costs incurred by you. Any client who is denied boarding on the outbound/inbound flight on the decision of the airline staff or aircraft captain shall be deemed to have given notice of cancellation on his/her booking at that moment, and cancellation charges will apply in accordance with cancellation charges above.
Laws of the country where you or your charter yacht is located
No-one in your party should commit an act contrary to the laws of the country. If any such act is committed, the agreement between us will automatically terminate, but without prejudice to our rights and those of the owner of the charter yacht. You and/or your party will carry full responsibility and answer to the appropriate Authorities.
Travel Insurance
It is obligatory that all members of your party have comprehensive travel insurance. By signing the charter contract you confirm that all members of your party are covered by private travel insurance. In all scenarios, I TRAVEL BY BOAT is a sales intermediary and cannot be held responsible for any event occurring on board or outside the vessel and during the transfers to/from the vessel.
Yacht Charter Complaint Procedure
We aim to provide you with the best yacht charter possible, but if a problem occurs you must report it to I TRAVEL BY BOAT as soon as possible, or to the captain who will try to resolve it on the spot. If you fail to follow this procedure I TRAVEL BY BOAT will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on your yacht charter vacation and this may affect your rights under this agreement. The Charter Contract is made on the terms of the particular yacht charter Booking Conditions and is governed in all respects by Panamanian Law and shall submit to the jurisdiction of the Panamanian Court.
